1. Who we are
This Privacy Policy explains how Klaros (Pty) Ltd, Reg. No. 2023/583749/07, VAT No. 4740313749, of 32 Fisk Road, Noordheuwel, Krugersdorp, 1739, South Africa ("Klaros", "we", "us") collects, uses and protects personal information when you use our website at klaros.co.za and the Klaros platform at tool.klaros.co.za (together, the "Service").
We process personal information in line with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Our Information Officer is Bryce Kurt Neumann, Director, who can be contacted using the details in section 13.
2. Information we collect
- Account information you give us when you register, subscribe or are invited by your company: your name, company name, email address, phone number and, where relevant, your industry association.
- Billing information such as invoice details and payment records. Card and bank details are entered on our payment provider's secure page and are not stored by Klaros.
- Usage information about how you use the platform, such as log-in times, searches, reports run and pages viewed.
- Technical information such as IP address, browser type and device information, collected through server logs and the cookies described in our Cookie Policy.
- Communications you send us, for example support queries.
3. Trade data and anonymisation
The Klaros platform presents South African customs import and export data sourced from SARS at Movement Reference Number (MRN) level. Individual traders are shown only by an anonymised reference number, and Klaros does not display their names or contact details as part of the trade data.
This anonymisation applies to the trade data shown on the platform. It is separate from the personal information we hold about you as a user, which is handled as described in this policy.
4. How we use information
- To create and manage your account and give you access to the Service;
- To process subscription payments, issue invoices and keep financial records;
- To send the reports and alerts you have subscribed to, and messages about your account, renewals and the Service;
- To keep the platform secure, including preventing unauthorised access and misuse;
- To improve the Service; and
- To meet our legal obligations, including tax and record-keeping requirements.
We process personal information where it is needed to provide the Service you or your company subscribed to, where the law requires it, where you have consented, or where we have a legitimate interest that does not override your rights.
5. Who we share information with
We do not sell personal information. We share it only with:
- Service providers who help us run the Service, under confidentiality obligations: hosting, email delivery, our payment processor (Paystack) and Google reCAPTCHA (to block automated sign-ups and log-ins);
- Your organisation: if your access is provided by your company or industry association, its account manager can see who has access under that subscription;
- Professional advisers, such as auditors and attorneys, where necessary; and
- Authorities, such as SARS, where the law requires it.
6. Information sent outside South Africa
Some of our service providers (for example email delivery, payment processing and reCAPTCHA) may store or process information outside South Africa. We only use providers that are bound by data-protection laws or agreements giving a level of protection comparable to POPIA.
7. Security
We take reasonable technical and organisational measures to protect personal information against loss, misuse and unauthorised access, including encrypted connections, one-time PIN verification and restricted access to our systems. No system is completely secure, but we work to keep information appropriately protected.
8. How long we keep information
We keep personal information for as long as your account is active and afterwards for as long as needed to meet our legal, tax and accounting obligations. It is then deleted or anonymised.
9. Your rights
You may ask us to confirm what personal information we hold about you, to give you access to it, and to correct or delete it. You may also object to certain processing, and you can stop the monthly alert emails at any time on the Email alerts page in the platform or with the link in each alert.
If you are not satisfied with how we have handled your information, you may lodge a complaint with the Information Regulator of South Africa (inforegulator.org.za).
10. Cookies
We use a small number of cookies that are needed to keep you signed in and to protect the platform. See our Cookie Policy for details.
11. Children
The Service is intended for business use and is not directed at children. We do not knowingly collect personal information from children.
12. Changes to this policy
We may update this policy from time to time. The date at the top of this page shows when it was last revised.
